Terms of Service
Terms of Service
Last updated: November 2026
1. Scope
1.1. These terms apply to all contracts between DUMMY_FIRMA, DUMMY_STRASSE, DUMMY_PLZ_ORT, DUMMY_LAND (the "Provider") and the customer for game server hosting through the Bajuma Gameservers platform (bajuma.games), including the free 48-hour trial (section 11).
2. Contract Formation
2.1. The services shown on the website are not a binding offer.
2.2. Every order requires a customer account.
2.3. By clicking "Order with obligation to pay" the customer makes a binding offer for the chosen server at the monthly price shown. The contract is formed as soon as the customer panel confirms the order.
2.4. The customer starts the free trial with "Start free trial". A paid contract only arises from it with "Keep server and pay" (section 11.5).
3. Services
3.1. The Provider supplies a virtual server with the chosen game, together with the customer panel, FTP access, backups within the backup allowance (section 6) and support through the ticket system.
3.2. Memory, CPU cores and storage follow the chosen package. The server is located in the country the customer chooses when ordering.
3.3. The Provider aims for an average availability of 99.5% per year. Planned maintenance and disruptions beyond its control are excluded.
3.4. The Provider may change the technical infrastructure and its operators as long as the agreed specification and the chosen country are kept.
4. Prices and Payment
4.1. The prices shown during the order apply. They are final prices; whether VAT is included is stated next to the price. The Provider currently is a small business and does not charge VAT.
4.2. Payment is made from prepaid credit. The customer tops up the account with the payment methods offered; payments are processed by Stripe.
4.3. The first month is deducted from the credit when ordering, every further month on the billing date. If the credit is likely to fall short, the Provider sends a reminder by e-mail three days before the billing date.
4.4. If the credit does not cover the monthly price on the billing date, the service ends on that day without a grace period. The server is stopped, backed up and deleted, and the customer receives an e-mail. If the backup fails, the server stays stopped for up to 24 hours while the backup is retried; after that it is deleted even without a new backup. If a backup no older than 24 hours already exists, the server is deleted at once.
4.5. A server ended this way can be reactivated in the customer panel as soon as the credit covers the monthly price. The latest existing backup is restored.
4.6. Discount vouchers apply for the stated number of months, starting with the first. Credit vouchers are added to the credit.
5. Term and Cancellation
5.1. Paid servers run for one month at a time. They renew automatically for one month as long as automatic renewal is switched on and the credit suffices.
5.2. The customer can cancel in the customer panel at any time, effective at the end of the paid period. The server keeps running until then and is backed up and deleted afterwards.
5.3. "Cancel immediately" ends the contract at once; the server is backed up and deleted. The remainder of the month already paid is not refunded.
5.4. The right to terminate for good cause remains unaffected.
6. Backups
6.1. The Provider keeps backups within the customer's backup allowance: currently 10 backups per account at no extra charge, or more with a backup plan.
6.2. Once the allowance is reached, the next backup deletes the oldest backup that is not pinned. Pinned backups are kept. Trial servers follow section 11.6.
6.3. Backups do not replace the customer's own backups of their data (section 7.4).
7. Customer Obligations
7.1. The customer keeps their login details secret and prevents unauthorized access.
7.2. The services must not be used for unlawful purposes, in particular not for distributing unlawful content, DDoS attacks, fraud or copyright infringement.
7.3. The customer is responsible for modifications and content on their server.
7.4. The customer regularly backs up their data themselves.
8. Liability
8.1. The Provider is liable without limitation for intent and gross negligence.
8.2. For slight negligence the Provider is only liable for breaches of essential contractual obligations, limited to the foreseeable damage typical for the contract.
8.3. For data loss the Provider is only liable to the extent of the effort a restore would have taken had the customer backed up their data regularly.
8.4. Liability for injury to life, body or health remains unaffected.
8.5. For the free trial the Provider is only liable for intent and gross negligence; section 8.4 remains unaffected.
9. Data Protection
How the Provider processes personal data is described in the Privacy Policy.
10. Dispute Resolution
The Provider is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. Complaints can be sent to DUMMY_EMAIL.
11. Free 48-Hour Trial
11.1. Offer. The Provider supplies a server of the "Spark" package, with the specification shown during the order, free of charge for 48 hours, for the games marked there with "Try free for 48 h". There is no entitlement to a trial. The Provider may limit the number of simultaneous trials and change or end the offer at any time; trials already running are not affected.
11.2. Who may try. Every customer account can try once. One trial is possible per internet connection within 30 days. Trying several times with several accounts or changing connections breaches these terms; the Provider may end such trials without notice.
11.3. Start and end. The 48 hours start as soon as the server is ready. The customer panel shows the time left and the end of the trial. The customer can end the trial early at any time with "End trial now".
11.4. Cost. The trial is free. The Provider asks for no payment method and deducts no credit. The trial does not turn into a paid contract automatically.
11.5. Keeping the server. With "Keep server and pay" the customer enters into a contract for the server at the monthly price shown. The first month is deducted from the credit at once and starts when the trial ends. The server and the game world are kept; sections 4 to 6 apply from then on.
11.6. End without keeping the server. When the trial ends, the server is stopped, the game world is backed up and the server is deleted. The backup is kept for 14 days. During that time the customer can reactivate the server with credit, and the world is restored. After that the Provider deletes the trial server's backups, pinned ones included. If the backup fails, it is retried for several hours; after that the server is deleted even without a backup.
11.7. Reminders. The Provider reminds the customer by e-mail 24 hours and 3 hours before the trial ends.
11.8. Scope of the trial. Games that require a licence per server cannot be tried, not even by switching games. The availability stated in section 3.3 does not apply to the trial.
11.9. Liability during the trial: section 8.5.
12. Final Provisions
12.1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country where they have their habitual residence.
12.2. If individual provisions are invalid, the remaining provisions stay valid.
12.3. The Provider announces changes to these terms by e-mail at least 30 days before they take effect. They apply to contracts concluded or renewed after that. If the customer does not agree, they can cancel at the end of the current period.
